This following user agreement describes the terms and conditions on which White Lotus Media (Zoomrz.com) offers you access to the Zoomrz.com platform.

These terms of service constitute a legally binding agreement (the “Agreement”) between you (“you,” or “your”) and White Lotus Media (Zoomrz.com) (“Zoomrz.com,” “we,” “us” or “our”), a private company, governing your use of the Zoomrz application, website, and technology platform (collectively, the “Zoomrz.com Platform”).

The Zoomrz.com Platform provides a marketplace where persons who seek photography services (“Customers”) can be matched with photographers & videographers in those destinations (“Photographers” & "Videographers"). Photographers & Videographers and Customers are collectively referred to herein as “Users” and each User shall create a User account that enables such User to access the Zoomrz.com Platform. For purposes of this Agreement, the services provided by Photographers & Videographers to Customers that are matched through the Platform shall be referred to collectively as the “Services”.

Zoomrz.com is not a photography or videography company. It is up to the Photographer or Videographer to decide whether or not to service a Customer contacted through the Zoomrz.com Platform, and it is up to the Customer to decide whether or not to accept services from any Photographer or Videographer contacted through the Zoomrz.com Platform. Any decision by a User to offer or accept Services once such User is matched through the Zoomrz.com Platform is a decision made in such User’s sole discretion. Each Service provided by a Photographer or a Videographer to a Customer shall constitute a separate agreement between such persons.

By creating your User account and using the Zoomrz.com Platform, you expressly acknowledge that you understand this Agreement and accept all of its terms. If you do not agree to be bound by the terms and conditions of this Agreement, you may not use or access the Zoomrz.com Platform or the Services.

Modification to the Agreement

We reserve the right to modify the terms and conditions of this Agreement at any time, effective upon posting the amended terms on this site. If we make changes, we will notify you by, at a minimum, revising the “Last Updated” date at the top of this Agreement. You are responsible for regularly reviewing this Agreement. Continued use of the Zoomrz.com Platform or Services after any such changes shall constitute your consent to such changes. If you do not agree to any such changes you may not use or access the Zoomrz.com Platform or the Services.

Eligibility

The Zoomrz.com Platform is available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, the Zoomrz.com Platform is not available to children (persons under the age of 18) or Users who have had their User account temporarily or permanently deactivated. By becoming a User, you represent and warrant that you are at least 18 years old and that you have the right, authority and capacity to enter into and abide by the terms and conditions of this Agreement.

Restricted Activities

With respect to your use of the Zoomrz.com Platform and your participation in the Services, you agree that you will not:

  1. impersonate any person or entity;

  2. stalk, threaten, or otherwise harass any person, or carry any weapons;

  3. violate any law, statute, ordinance or regulation;

  4. interfere with or disrupt the Services or the Zoomrz.com Platform or the servers or networks connected to the Zoomrz Platform;

  5. post Information or interact on the Zoomrz.com Platform or Services in a manner which is false, inaccurate, misleading (directly or by omission or failure to update information), defamatory, libelous, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, or illegal;

  6. use the Zoomrz.com Platform in any way that infringes any third party’s rights, including but not limited to: intellectual property rights, copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

  7. post, email or otherwise transmit any malicious code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or surreptitiously intercept or expropriate any system, data or personal information;

  8. forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Zoomrz.com Platform;

  9. “frame” or “mirror” any part of the Zoomrz.com Platform, without our prior written authorization or use meta tags or code or other devices containing any reference to us in order to direct any person to any other web site for any purpose; or

  10. modify, adapt, translate, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Zoomrz.com Platform or any software used on or for the Zoomrz.com Platform;

  11. rent, lease, lend, sell, redistribute, license or sublicense the Zoomrz.com Platform or access to any portion of the Zoomrz.com Platform;

  12. use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, scrape, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Zoomrz.com Platform or its contents;

  13. create liability for us or cause us to become subject to regulation unnecessarily

  14. transfer or sell your User account, password and/or identification to any other party; or

  15. cause any third party to engage in the restricted activities above.

We reserve the right, but we have no obligation, to suspend or deactivate your User account if you do not comply with these prohibitions.

Photographer Representations and Warranties:

By providing Services as a Photographer on the Zoomrz.com Platform, you represent, warrant, and agree that:

You possess valid and genuine photography skills and are authorized and medically fit to operate camera and related equipment in an appropriate manner.

You own, or have the legal right to operate, the camera and equipment you use when providing Services, and such camera and equipment is in good operating condition

You will only provide Services using the camera that has been reported to and for which a photograph has been provided to Zoomrz.com

You will be solely responsible for any and all liability that results from or is alleged as a result of your provision of Services, including, but not limited to personal injuries, death and property damages.

You will comply with all applicable laws, rules and regulations while providing Services and you will be solely responsible for any violations of such provisions.

You will pay all applicable central, state and local taxes based on your provision of Services and any payments received by you.

You will not make any misrepresentation regarding Zoomrz.com, the Zoomrz.com Platform, the Services or your status as a Photographer, or, while providing the Services or engage in any other activity in a manner that is inconsistent with your obligations under this Agreement.

You will not attempt to defraud Zoomrz.com or Customers in connection with your provision of Services. If we suspect that you have engaged in fraudulent activity we may withhold applicable Service Fees or other payments for the Service(s) in question.

You will not discriminate or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation. You will make reasonable accommodation and arrangements to photo-shoot pets, birds and wild animals, as and when required.

You agree that we may obtain information about you, including your criminal records, and you agree to provide any further necessary authorizations to facilitate our access to such records during the term of the Agreement.

Videographer Representations and Warranties:

By providing Services as a Videographer on the Zoomrz.com Platform, you represent, warrant, and agree that:

You possess valid and genuine photography skills and are authorized and medically fit to operate camera and related equipment in an appropriate manner.

You own, or have the legal right to operate, the camera and equipment you use when providing Services, and such camera and equipment is in good operating condition

You will only provide Services using the camera that has been reported to and for which a photograph has been provided to Zoomrz.com

You will be solely responsible for any and all liability that results from or is alleged as a result of your provision of Services, including, but not limited to personal injuries, death and property damages.

You will comply with all applicable laws, rules and regulations while providing Services and you will be solely responsible for any violations of such provisions.

You will pay all applicable central, state and local taxes based on your provision of Services and any payments received by you.

You will not make any misrepresentation regarding Zoomrz.com, the Zoomrz.com Platform, the Services or your status as a Videographer, or, while providing the Services or engage in any other activity in a manner that is inconsistent with your obligations under this Agreement.

You will not attempt to defraud Zoomrz.com or Customers in connection with your provision of Services. If we suspect that you have engaged in fraudulent activity we may withhold applicable Service Fees or other payments for the Service(s) in question.

At White Lotus Media (Zoomrz.com), we strive to provide exceptional service and ensure the satisfaction of our valued customers. We understand that unforeseen circumstances may arise, and we have implemented a refund policy to address certain situations.

 

1. Execution of Services: We have a 100% satisfaction guarantee policy (limited to the fees paid for your Zoomrz). Simply contact us with any concerns at support@zoomrz.com. We'll make it right! Moreover, we again wish to affirm that only tested, vetted and real professionals are our Zoomrz !. We also like to remind you that, Zoomrz.com is an intermediate bridge between customers requiring photographers/videographers and professional photographers/videographers accepting assignments from customers.

Our team of photographers and videographers are real professionals who are very much aware about the importance of shooting photographs & videos in any given event. Moreover, we at the back office always ensure that the photographer or videographer reaches the event location earlier to keep the client in peace of mind and if for any reason they are not able to reach, we'll try and fix another photographer or videographer. You can call us, so we can expedite your request. Reach out to call us or Whatsapp at 9941522000 or 9500095581 and we will do everything in our power to resolve the issue and find a solution that is to your satisfaction.

If, after all efforts, we were not able to fix another photographer or videographer, our refund policy solely covers the shoot amount paid and does not include any additional expenditures or costs incurred by the customer.

2. Lost or Corrupted Data: In the unfortunate event of data loss or corruption, we deeply regret any inconvenience caused. While we take precautions to safeguard your data, we cannot guarantee its absolute protection. If such an incident occurs during your shoot, we will assess the situation on a case-by-case basis. In the event that the lost or corrupted data is deemed unrecoverable, our maximum refund will be limited to the amount paid for the shoot.

3. Reasonable Missing Data: We make every effort to ensure that all captured data is accurately preserved. However, if there are reasonable instances of missing data, we apologize for any inconvenience caused. Our team will investigate and determine the cause of the missing data. If it is deemed to be a result of our actions or negligence, we will provide a maximum refund equivalent to the amount paid for the shoot.

 

Please note the following:

- Our refund policy solely covers the shoot amount paid and does not include any additional expenditures or costs incurred by the customer.

- We are not liable for any indirect or consequential damages arising from lost or corrupted data or reasonable missing data.

1. Cash On Hand: We regret to inform you that we do not accept cash payments on hand. As part of our commitment to safety and efficiency, we have opted for alternative payment methods to provide a seamless experience.

2. Deposit Cash: If you prefer to make a payment in cash, we offer the option to deposit cash directly into our business account. Please contact our customer support team for the necessary account details. Once the cash deposit is confirmed, we will proceed with your booking or service as requested.

3. Alternative Payment Methods: We provide various convenient and secure payment options, including credit/debit cards, online bank transfers, and mobile payment apps. These options ensure a quick and hassle-free payment process, allowing you to enjoy our services without the need for cash.

Location Selection and Permission Responsibility: 

At White Lotus Media (Zoomrz.com), we understand the importance of capturing stunning photographs in unique locations. If they book our services for Outdoor Photography/Videography, we offer our clients the flexibility to choose their desired shooting locations. However, please note the following regarding location selection and permission:

1. Client Responsibility: Selecting a location for the shoot is the client's responsibility. We encourage you to choose a location that aligns with your vision and preferences. Whether it's a public park, a private property, or any other venue, it's important to ensure that you have the necessary permission to conduct the shoot.

2. Obtain Permissions: It is the client's responsibility to obtain any required permissions, permits, or authorizations from relevant authorities or property owners. This includes securing permits for commercial photography, acquiring access to private venues, and adhering to any local regulations or restrictions.

3. Collaboration and Guidance: We are happy to provide recommendations and assist you in finding suitable locations for your shoot. However, the final decision and responsibility for obtaining permissions lie with the client.

4. Liability: In the event that any issues or conflicts arise related to the shoot location, including but not limited to legal matters or property disputes, the client assumes full responsibility and liability. White Lotus Media (Zoomrz.com), and our photographers shall not be held responsible for any consequences arising from the selection or use of a particular location.

We highly recommend thorough research and communication with the relevant authorities or property owners to ensure a smooth and successful shoot at your chosen location.

Early Departure Policy for Completed Sessions:

2. Team Flexibility: In the event of an early completion, our team members may be allowed to leave the location early, provided all aspects of the session have been concluded to your satisfaction. This allows our team members to manage their schedules effectively and attend to other commitments.

3. Client Satisfaction: Your satisfaction is our top priority. Before allowing our team members to leave early, we will ensure that you are completely satisfied with the session and have received all the shots and services as agreed upon.

If you have any last-minute requests or adjustments, please inform our team during the session to ensure all your needs are met before their departure.

Additional Support Time in Case of Photographer Delay:

1. Customer Satisfaction: Your satisfaction is our top priority, and we want to ensure that you receive the full duration of the photography service you booked. If our photographer experiences any unexpected delay that impacts the start time of the session, we will make every effort to compensate for the lost time.

2. Additional Support Time: In the event of a delay caused by our photographer, we will extend the session duration to accommodate for the time lost. This additional support time will be provided at no additional cost to you.

3. Open Communication: We believe in maintaining transparent communication with our customers. If our photographer anticipates any potential delays or encounters unforeseen circumstances, we will inform you promptly and provide an updated estimated arrival time. Bad Weather Rescheduling Policy:

If the weather conditions on the day of your scheduled shoot are deemed unsuitable or unsafe by our team, we will work closely with you to reschedule the booking. Here's how our bad weather rescheduling policy works:

1. Assessment and Communication: Our team will closely monitor the weather conditions leading up to your scheduled shoot. If adverse weather conditions are expected, we will reach out to you in advance to discuss the situation and explore the possibility of rescheduling.

2. Safety and Quality Assurance: The safety of our clients and our photographers is of utmost importance. We will consider factors such as heavy rain, thunderstorms, strong winds, or any other conditions that may pose risks to the shoot or compromise the quality of the photographs.

3. Flexible Rescheduling: We understand that your schedule may be affected by a rescheduling request due to bad weather. We will make every effort to find a suitable date and time that works for both parties, ensuring you have the best possible conditions for your shoot.

4. Open Communication: Throughout the rescheduling process, we will maintain open and transparent communication with you. Our team will provide updates, alternative options, and address any concerns or questions you may have.

Please note that while we do our best to anticipate and manage weather-related challenges, we are unable to control or predict sudden weather changes. Our decision to reschedule is based on the best interest of your safety and the quality of the final photographs.

Photo Shoot Cancellation Policy:

  1. No cancellation fee - if you cancel more than 72 hours before your  scheduled Zoomrz session. Or we can reschedule the photoshoot within 1 week to a convenient time that suits both the photographer and the client.

  2. 50% cancellation fee - if you cancel less than 48 hours and upto 24 hours before your scheduled Zoomrz session.

All cancellation fee refunds will be issued via the same method as the original payment (e.g. Bank Transfer, Credit or Debit Cards). We will process your refund within 10 business days from the date of the request.

Data and Copyright Policy:

Data Usage and Consent: By using our services, you grant permission to White Lotus Media, operating under the brand name "Zoomrz.com," and its representatives to capture and record your image, voice, and related data during your photography session. This includes photographs, video images, and voice recordings.

2. Ownership and Usage Rights: All photographs, video images, and voice recordings captured by Zoomrz.com and its representatives during your session are the property of White Lotus Media. We retain the exclusive rights to reproduce, use, exhibit, display, broadcast, and distribute these images and recordings in any media now known or developed in the future. These rights are granted for the purpose of promoting, publicizing, explaining White Lotus Media, its activities, and for administrative, educational, or research purposes.

3. Responsibility for Permission: It is your responsibility to ensure that you have the necessary permissions and rights to grant access to White Lotus Media and its representatives to photograph and record your image and voice during your booking. By granting permission on behalf of any other person involved in your booking, you confirm that you have obtained their consent for the use of their image and recordings as outlined in this policy.

4. Use of Name: You grant permission to White Lotus Media to use your name in connection with the images and recordings captured during your photography session. This allows us to appropriately credit your involvement and ensure transparency in our promotional and educational materials.

5. Data Security and Confidentiality: White Lotus Media maintains strict data security measures to protect your personal information, images, and recordings. We handle your data in accordance with applicable data protection laws and regulations.

We want to assure you that we value your privacy and will use your data and images responsibly and in compliance with relevant legal requirements. Image Delivery Policy:

At White Lotus Media (Zoomrz.com), we strive to provide timely and efficient image delivery to our valued customers. We understand the importance of receiving your cherished memories promptly. To ensure transparency and clarity, we have established the following policy for image delivery:

1. Delivery Timeline: We ensure our photographers commit to delivering your  images within 48 working hours from the time of your photography session and ensure our videographers to delivering your edited footage within 96 working hours from the time of your videography session. Working hours are defined as Monday to Saturday, between 10 AM and 7 PM, excluding Sundays and public holidays.

2. Efficient Editing Process: Our team of skilled professional photographers shoot photographs at high standards and hence, we do not edit photographs of Photo Lite and Photo Pro packages but for Photo Premium package, our  editors work diligently to process and enhance your images to the highest standards. We prioritize quality while maintaining an efficient workflow to meet the 48-hour delivery timeline. As far as Video packages are concerned we insist our clients to choose our in-house editing option along with video shoot package, to ensure high standard quality.

3. Communication and Updates: Throughout the editing process, we maintain open communication to keep you informed about the progress of your images. If any unexpected delays occur, we will promptly inform you and provide an updated delivery timeline.

4. Weekends and Public Holidays: Please note that our image delivery timeline excludes weekends Sundays and public holidays. Delivery of images will resume on the next working day following a weekend or public holiday.

5. Exceptional Circumstances: In rare cases where unforeseen circumstances may cause a delay in image delivery, we will notify you promptly and work closely with you to resolve the issue as quickly as possible. We are committed to providing exceptional customer service and ensuring your satisfaction.

We want to assure you that our team is dedicated to delivering your images within the stipulated timeframe. We understand the significance of your memories and aim to provide you with a seamless and enjoyable photography experience.

Term and Termination

This Agreement is effective upon your creation of a User account, as amended by any modifications that may be made from time to time. You may discontinue your use of the Zoomrz.com Platform or participation in the Services at any time, for any reason. We may suspend or deactivate your User account (either as a Customer and/or Photographer), or revoke your permission to access the Zoomrz.com Platform, at any time, for any reason, upon notice to you. We reserve the right to refuse access to the Zoomrz.com Platform to any User for any reason whatsoever.

Agreement to Arbitrate All Disputes and Legal Claims

You and We agree that any legal disputes or claims arising out of or related to the Agreement (including but not limited to the use of the Zoomrz.com Platform and/or the Services, or the interpretation, enforceability, revocability, or validity of the Agreement), that cannot be resolved informally shall be finally decided by the board of directors of White Lotus Media (Zoomrz.com).

Confidentiality

You agree not to use any technical, financial, strategic and other proprietary and confidential information relating to Zoomrz.com business, operations and properties, including User information (“Confidential Information”) disclosed to you by Zoomrz.com for your own use or for any purpose other than as contemplated herein. You shall not disclose or permit disclosure of any Confidential Information to third parties. You agree to take all reasonable measures to protect the secrecy of and avoid disclosure or use of Confidential Information of Zoomrz.com in order to prevent it from falling into the public domain.

 

No Agency

You and Zoomrz.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.

Notices, Complaints

Except as explicitly stated otherwise, any notices to Zoomrz.com shall be given by registered post to:

White Lotus Media (Zoomrz.com), O.No. 294. N.No.212. Arcot Road, Kodambakkam,  Chennai – 600024, (Near Power House Bus Stop).

Any notices to you shall be provided to you through the Zoomrz.com Platform or given to you via the email address you provide to Zoomrz.com during the registration process, and such notice shall be deemed given immediately upon sending. Alternatively, we may give you notice by courier or registered post to the address provided to Zoomrz.com during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.

To resolve a complaint regarding the Zoomrz.com Platform, you should first contact with complete details on support@zoomrz.com

General

This Agreement shall be governed by the laws of India. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. You agree that this Agreement and all incorporated agreements may be automatically assigned by White Lotus Media (Zoomrz.com), in our sole discretion in accordance with this Agreement. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. A party’s failure to act with respect to a breach by the other party does not constitute a waiver of the party’s right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between you and White Lotus Media (Zoomrz.com) with respect to the subject matter hereof.
